Counseling Services

We work with Employers to provide direction and guidance on the structure and implementation of their immigration program. Whether a client is building its immigration program from scratch or simply needs a review and update of its existing program, we partner with our clients to develop appropriate solutions. A properly developed immigration program will consider the client size, industry, structure, staffing, hiring practices and business objectives.

We work directly with clients and their corporate counsel on the immigration implications associated with mergers and acquisitions, divestitures and reorganization activities. We participate in due diligence investigations, analysis of the immigration status of existing international employees, the impact of the corporate change on each employee’s status, and the filing of petitions necessary to ensure maintenance of each employee’s status.

Employer Compliance

Aggressive enforcement efforts and constantly fluctuating regulatory requirements for hiring foreign nationals and verifying employment eligibility are intrinsic to today’s immigration environment. As a result, employers across the globe must be vigilant in complying with all aspects of immigration-related laws and regulations. The increasingly global marketplace, national security concerns, and mandated initiatives calling for a renewed sense of corporate responsibility are compelling businesses to make immigration compliance a top priority.

Audits

We have vast experience in helping Employers comply with immigration laws and regulations, including I-9 Compliance and H-1B Compliance. U.S. Employers have for decades been the focus of immigration compliance.

We can assist with an Employers conducted internal review of their employment eligibility verification and visa programs or we can handle the review for the Employer. We work with Employers to develop solutions to address compliance concerns, including client-specific training. We also represent employers subject to government audited and investigations.

Business Visitor Compliance

The U.S. and countries around the globe are more strictly enforcing their immigration laws and penalties, particularly with respect to business visitors. In today’s global economy Employees are traveling more frequently to other countries. It fairly common for Employees to travel as “business visitors”. However, incidents of noncompliance are common among short-term business travelers, who may mistakenly assume that they do not require work permits because of the brevity of their stay and can consequently “fall under the radar” of an employer’s mobility program.

We provide comprehensive analysis of each Employee’s intended travel to the U.S. or abroad. We conduct thorough compliance assessments of employees’ short-term travel plans, including the activities to be undertaken while on business travel, and the nationality, residence and immigration status of the employees.
